TERMS OF SERVICE

Welcome to Marlow's on the Kenai. These Terms of Service ("Terms") govern your use of our website marlowsonthekenai.com, our reservation services, our SMS messaging program, and any related offerings (collectively, the "Services"). By accessing the website, submitting an inquiry, or receiving messages from us, you agree to these Terms.

Acceptance of Terms

By using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Minors may stay at Marlow's only when accompanied by a parent or legal guardian who has made the reservation.

Reservations and Bookings

All reservations are subject to availability and confirmation by Marlow's. Submitting an inquiry through our website is a request, not a confirmed booking. A reservation is confirmed only once Marlow's communicates confirmation and a deposit has been received.

Deposit and Payment

A 50% deposit is required to hold your reservation. The remaining balance is due 60 days before your arrival date. For guided fishing packages and group property rentals, the deposit also secures guide and charter slots — these dates often book out 9 to 12 months in advance.

Cancellation and Refund Policy

• More than 90 days before arrival: Deposits are refundable, less a small processing fee.
• Between 60 and 90 days before arrival: Deposits are refundable only if we are able to re-book your dates.
• Within 60 days of arrival: Deposits are non-refundable. We will work with you on date changes wherever possible.

Travel insurance is strongly recommended and is the sole responsibility of the guest.

SMS Messaging Program

By providing your mobile number and opting in via the reservation inquiry form or another explicit consent method, you agree to receive text messages from Marlow's on the Kenai for purposes including:

• Booking confirmations and reservation details
• Deposit and payment reminders
• Arrival day logistics, cabin assignments, and directions
• Pre-trip updates such as weather, regulations, or packing reminders
• Optional marketing messages regarding availability and seasonal offers (only if you have opted in to marketing messages)

Message frequency: Approximately 4–8 messages per trip for transactional communications, and 1–2 messages per month for marketing communications (if opted in).

Message and data rates may apply. Your carrier's standard messaging rates apply to all texts you send and receive.

How to opt out: Reply STOP to any message to unsubscribe. You will receive a confirmation message and will no longer receive texts from us.

Carriers are not liable for delayed or undelivered messages. See our Privacy Policy for details on how we handle your mobile information. Mobile opt-in data is never shared with third parties or affiliates for their marketing or promotional purposes.

Property Use and Guest Conduct

By staying at Marlow's, you agree to:

• Treat the property, cabins, docks, equipment, and natural surroundings with care
• Follow all posted safety guidelines, fire rules, and wildlife precautions
• Comply with all Alaska Department of Fish and Game regulations, emergency orders, and license requirements when fishing
• Not sublet or transfer your reservation without written approval from Marlow's
• Keep the number of guests within the agreed-upon cabin capacity

Marlow's reserves the right to remove guests from the property, without refund, for destructive conduct, harassment of other guests or staff, or violation of Alaska law.

Assumption of Risk and Liability

Fishing, boating, wildlife viewing, and outdoor activities on and around the Kenai River involve inherent risks, including but not limited to cold water, swift currents, slippery surfaces, changeable weather, bears and other wildlife, and the use of boats and fishing equipment. Guests assume these risks voluntarily.

Marlow's is not responsible for personal injury, illness, lost or damaged personal property, or other losses arising from activities on or off the property, including guided fishing trips, ocean charters, and fly-out adventures operated by third-party vendors.

Separate liability waivers may be required for specific activities (e.g., guided boat trips, fly-outs, ocean charters) and are administered by the guide or charter operator, not by Marlow's.

Third-Party Guides and Charters

Marlow's coordinates guided river trips, ocean charters out of Homer, Seward, and Ninilchik, and fly-out trips with trusted third-party partners. These partners are independent operators, not employees of Marlow's. Marlow's acts as a booking coordinator and is not liable for acts, omissions, schedule changes, cancellations, or conditions of third-party guides or charter operators. Disputes arising from third-party services should be addressed directly with the operator involved.

Alaska Fishing Regulations

All guests 16 years of age and older are required to obtain a valid Alaska sport fishing license before fishing. Specific species may require additional stamps or be subject to closures or emergency orders from the Alaska Department of Fish and Game (ADF&G). Guests are responsible for complying with current regulations, which can be found at adfg.alaska.gov.

Intellectual Property

All content on this website — including text, photographs, video, graphics, and the Marlow's on the Kenai name and logo — is owned by Marlow's or licensed to us and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.

Website Use

You agree not to:

• Use the website or any services in any unlawful manner or for any unlawful purpose
• Attempt to gain unauthorized access to systems, accounts, or data
• Scrape, harvest, or otherwise collect information from the website by automated means without permission
• Impersonate another person or entity when submitting inquiries
• Submit false, misleading, or fraudulent information

Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. Marlow's does not guarantee specific fishing results, weather conditions, wildlife sightings, or other natural outcomes of your trip. While we work to provide accurate information on our website, we do not warrant the accuracy or completeness of any content.

Limitation of Liability

To the maximum extent permitted by law, Marlow's total liability to you for any claim arising out of or relating to your use of the Services shall not exceed the amount you paid to Marlow's for the reservation giving rise to the claim. In no event shall Marlow's be liable for indirect, incidental, consequential, or punitive damages.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Alaska, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in the State of Alaska, and you consent to the personal jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. Updated Terms are effective when posted on this page, and the "Effective Date" at the top of the page reflects the most recent revision. Continued use of the Services after changes constitutes acceptance of the revised Terms.
